Getting started
We have build over controls and regulations in place to help ensure our sewer, water and roof water harvesting networks are adequately protected and can be accessed for maintenance purposes. That’s why we need to give approval to build some structures over our assets or within our easements.
If you’re planning any works near our assets or easements, you need to apply for approval before you start building. To learn more about what structures we may approve and how we assess them, read our Quick Reference Guide.
Things to know
Find out what you need to do before you make an inquiry.
To make an initial inquiry, you need to provide us with:
- Applicant details
- Land owner details
- Address for proposed works
- Description of the works – for example, garden shed, garage, verandah
- Description of the materials
- Site plan showing the distance of the proposed structure/works from the property boundaries
- Building plan
- Construction method drawings
- Any preliminary footing/foundation designs – for example, drawings showing angle of repose
- Any preliminary structural details of the proposed building or works
Note that this is the first step in applying for approval, it doesn’t guarantee you’ll get approval.
$104.42 (GST exempt)
If your proposed works get approved, we’ll send you an invoice. You can pay by cheque, credit card or EFTPOS.
The fee is non-refundable and covers the assessment of the proposed works.
This inquiry is for us to assess the preliminary drawings for your proposed works. We’ll let you know if we’re likely to give approval before you produce detailed design drawings.
Construction over our assets or within our easements without approval is an offence under section 148 of the Water Act 1989 (VIC).

Complete this application if you’re proposing to build:
- Within an easement
- Over an asset
- Within 1 metre of an asset
What happens next?
We’ll send you more detailed guidance or let you know if we need any more information within 5 days of receiving your inquiry.
If your application meets the build over requirements, we’ll send you a Consent to Erect a Structure (otherwise known as a Build Over Agreement) under S148 of the Water Act 1989. The property owner needs to sign this consent.
If you get approval, you may start your works, subject to having all other relevant permits and approvals required by law.
